B.K.S.I. PACKING vindt Uw privacy belangrijk. Wij engageren ons om Uw recht op privacy en gegevensbescherming te vrijwaren en te beschermen conform het hierna vermelde beleid. Dit document legt de specifieke voorwaarden vast inzake de verwerking van Uw Persoonsgegevens. Op de toepassing van het hierna bepaalde privacy beleid is het Belgisch recht van toepassing. De rechtbanken territoriaal bevoegd voor de maatschappelijke zetel van B.K.S.I. PACKING zijn exclusief bevoegd bij eventuele geschillen.

Dit beleidsdocument inzake privacy bepaalt niets over de verwerking van Persoonsgegevens door Derden.

1 - Definities

• “Persoonsgegevens” verwijst naar alle informatie over een geïdentificeerde of identificeerbare natuurlijkepersoon (de “Betrokkene”). Als identificeerbaar wordt beschouwd een natuurlijke persoon die direct ofindirect kan worden geïdentificeerd, met name aan de hand van een identificator zoals een naam, eenidentificatienummer, locatiegegevens, een online identificator of een of meer elementen die kenmerkendzijn voor de fysieke, fysiologische, genetische, psychische, economische, culturele of sociale identiteit.
• “U” verwijst naar een Betrokkene in zijn/haar hoedanigheid van bezoeker van onze Website.
• “Verwerkingsverantwoordelijke” verwijst naar B.K.S.I. PACKING, vennootschap naar Belgisch recht, metzetel te Bredabaan 173 te 2170 Antwerpen, en met ondernemingsnummer 0440.976.846 –commercial@bksi.be T +32 (0)3 645 38 80 F +32 (0)3 645 77 97 (verder “B.K.S.I. PACKING” of “Wij”).
• “Verwerker” verwijst naar een natuurlijk persoon of rechtspersoon, een overheidsinstantie, een dienst ofeen ander orgaan die/dat ten behoeve van B.K.S.I. PACKING Uw Persoonsgegevens verwerkt.
• “Website” verwijst naar onze site https://www.bksi.be/.
• “Derde” verwijst naar een natuurlijke of rechtspersoon, een overheidsinstantie, een dienst of een anderorgaan, niet zijnde de Betrokkene, noch B.K.S.I. PACKING, noch haar Verwerkers, noch de personen dieonder het rechtstreeks gezag van B.K.S.I. PACKING of haar Verwerkers gemachtigd zijn Persoonsgegevenste verwerken. De verwerking van Persoonsgegevens door Derden zal vastgelegd zijn in het van toepassingzijnde privacy beleid van die Derde.

2 - Welke Persoonsgegevens

B.K.S.I. PACKING streeft ernaar om het minimum aan Persoonsgegevens te verwerken die nodig zijn voor de uitoefening van haar activiteiten. In dat opzicht kunnen wij overgaan tot het verwerken van o.m. volgende algemene persoonsgegevens:

• “Persoonlijke identificatiegegevens” wat o.m. kan verwijzen naar:
  
  • Naam, titel, adres (privé, werk), in voorkomend geval vroegere adressen en e-mailadressen.
  • Telefoon- of GSM nummer (privé, werk).
• “Identificatiegegevens, andere dan rijksregisternummer, uitgeven door de overheid” wat o.m. kanverwijzen naar:
  
  • Identiteitskaartnummer, paspoortnummer.
• “Elektronische identificatiegegevens” wat o.m. kan verwijzen naar:
  
  • IP-adressen, cookies, verbindingsmomenten, trackingpixels, tags, scripts.
• “Elektronische lokalisatiegegevens” wat kan verwijzen naar:
  
  • GSM, GPS.
• “Financiële gegevens” wat o.m. kan verwijzen naar:
  
  • Bankgegevens en bankrekeningnummers.
• “Persoonlijke kenmerken” wat o.m. kan verwijzen naar:
  
  • Geslacht, geboortedatum, geboorteplaats, burgerlijke staat, nationaliteit.
• “Ter beschikking gestelde gegevens” wat o.m. kan verwijzen naar:
  
  • Gegevens die gepubliceerd zijn op of beschikbaar zijn op o.m. Uw profiel op sociale media die publiektoegankelijk zijn.
  • Gegevens van referenties en contactpersonen in noodgevallen.
  • Informatie die U ons doorstuurt of overhandigt.

3 - Doel van de verwerking en rechtsgrond

De verzamelde Persoonsgegevens worden gebruikt bij de uitvoering van de activiteiten, waaronder:

• Klantenbeheer m.n. alles wat te maken heeft met de administratie van het cliënteel, het beheer van dedienstverlening, uitvoering en facturatie van de dienstverlening, het opvolgen van de betalingen en desolvabiliteit.
• Leveranciersbeheer m.n. alles wat te maken heeft met de leveranciersadministratie. Het beheer van deopgegeven aanvragen, de betaling van de leveranciers, de prospectie van mogelijke leveranciers en hunevaluatie.
• Fusie / overname m.n. alles wat te maken heeft met de overdracht van Persoonsgegevens in het kader vaneen fusie met of een overname van het geheel of een deel van de activa door een ander bedrijf.
• Bestrijding van fraude en inbreuken m.n. alles wat te maken heeft met activiteiten waardoor zulkehandelingen kunnen worden voorkomen en opgespoord.
• Beveiliging m.n. alles wat te maken heeft met het verwerken van Persoonsgegevens om de veiligheid tewaarborgen van personen of goederen, de veiligheid en/of goede technische werking van de ITnetwerksysteem, de Website, apps en producten minstens om de (fysieke) bescherming van deonderneming te verzekeren en dit alles met het oog op de continuïteit van de dienstverlening.
• Beheer van betwistingen en geschillen m.n. alles wat te maken heeft met het beheren van eigenbetwistingen en geschillen, gehoor geven aan gerechtelijke of scheidsrechtelijke bevelen, in het kader vangerechtelijke procedures, eigen rechten uit te oefenen, verdediging tegen rechtsvorderingen, voldoen aancontractuele en wettelijk opgelegde verplichtingen, toezicht op gelijke kansen en verweer tegenvorderingen inzake discriminatie, informatie verschaffen om misdrijven te voorkomen.
• Websitemanagement m.n. alles wat te maken heeft met het algemeen beheer van de Website met als doeldeze beschikbaar en toegankelijk te maken voor de bezoekers.
• Netwerking m.n. alles wat te maken heeft met netwerkevenementen, social events, happenings, beurzen, …
• Optreden in noodsituaties m.n. alles wat te maken heeft met het contacteren van de opgegeven personenindien er zich een noodgeval voordoet.
• Public relations m.n. alles wat te maken heeft met gepersonaliseerde marketing en reclame, businessdevelopment, marktonderzoek en statistische analyse in het kader van de individuele dienstverlening enlouter voor intern gebruik.
• Technisch-commerciële inlichtingen m.n. alles wat te maken heeft met de analyse van concurrenten eneventuele handelspartners.
• Directe marketing m.n. alles wat te maken heeft met prospectie, activiteiten, diensten aangeboden doorcommerciële firma’s, liefdadigheidsinstellingen of andere verenigingen of stichtingen, o.a. deze vanpolitieke aard, aan bevolkingssegmenten. Het communicatiemiddel dat hiertoe gebruikt wordt, kan post,telefoon of andere rechtstreekse middelen (bijv. e-mail,…) zijn. Het heeft geen belang of de geadresseerdereeds klant is of niet.

Deze Persoonsgegevens worden slechts verwerkt voor zover deze verwerking rechtmatig is. In dat opzicht is de verwerking van Uw Persoonsgegevens in hoofdzaak noodzakelijk voor de goede uitvoering van de met U afgesloten overeenkomsten of om op Uw verzoek voor de sluiting van een overeenkomst maatregelen te nemen. De verwerking kan ook noodzakelijk zijn indien voldaan moet worden aan de wettelijke verplichtingen die op B.K.S.I. PACKING rusten waarbij o.m. verwezen kan worden naar de wettelijke verplichtingen inzake fiscaal recht en sociaal recht. Verder kunnen aan B.K.S.I. PACKING ook verplichtingen opgelegd worden in het kader van gerechtelijke of buitengerechtelijke geschillenbetwistingen, door ordehandhavingsdiensten, overheden, … Occasioneel zal tot de verwerking van Uw Persoonsgegevens worden overgegaan om Uw vitale belangen of deze van een andere natuurlijke persoon te beschermen. Daarenboven kan het soms zijn dat tot verwerking wordt overgegaan omwille van gerechtvaardigde belangen in hoofde van B.K.S.I. PACKING. Indien U gebruik maakt van de Website, kan B.K.S.I. PACKING bepaalde Persoonsgegevens gebruiken voor doeleinden die de Website en de dienstverlening van B.K.S.I. PACKING ondersteunt of die tot een betere functionaliteit aanleiding geeft. Indien de van toepassing zijnde wetgeving tot slot vereist dat voor de verwerking van bepaalde Persoonsgegevens Uw toestemming is vereist, wordt U hierom uiteraard verzocht. Indien deze toestemming wordt gegeven, kan U deze toestemming te allen tijde intrekken. Hiervoor zal U een kennisgeving richten aan commercial@bksi.be waaruit blijkt dat U Uw toestemming hebt ingetrokken. Alsdan zullen Uw Persoonsgegevens niet langer verwerkt worden voor de doeleinden waarmee oorspronkelijk Uw instemming werd verleend, tenzij een andere rechtsgrond tot gevolg heeft dit wel te doen.

4 - Overdracht van Persoonsgegevens

Uw Persoonsgegevens worden verwerkt door de werknemers, lasthebbers en aangestelden van B.K.S.I. PACKING. Hierbij wordt er op toegezien dat enkel die Persoonsgegevens worden verwerkt die voor de uitoefening van de opdracht nodig zijn. Met o.m. volgende categorieën van ontvangers kunnen, indien voldaan aan de wettelijke voorwaarden, Uw Persoonsgegevens echter gedeeld worden:

• Uw persoonlijke relaties.
• Uw professionele raadgevers.
• Uw werkgever of zakenrelatie.
• Individuen of organisaties in een contractuele relatie met B.K.S.I. PACKING.
• Post-, transport- en andere bezorgbedrijven om onze post beter te kunnen verzenden.
• Andere (privé) ondernemingen.
• Overheidsdiensten.
• Sociale zekerheidsinstanties.
• Gerecht, scheidsrechtelijke instanties en ordehandhavingsdiensten.
• Banken en verzekeringsmaatschappijen.
• Verbonden en geassocieerde vennootschappen van B.K.S.I. PACKING.

Het kan voorkomen dat we Uw Persoonsgegevens delen met Verwerkers. Dit omvat bijvoorbeeld:

• IT-dienstverleners.
• Bedrijven die credit checks en antecedentenonderzoek doen.
• Betalingsverwerkings- en softwarebedrijven.
• Banken en verzekeringsmaatschappijen.
• ...

Deze Verwerkers worden door B.K.S.I. PACKING aangesteld en zijn dus ook bevoegd om Uw Persoonsgegevens te verwerken voor zover dit nodig is voor onze dienstverlening. Deze Verwerkers moeten hierbij wel rekening houden met de instructies en het privacy beleid van B.K.S.I. PACKING.

Het kan voorkomen dat B.K.S.I. PACKING Uw Persoonsgegevens moet delen met gerechtelijke of scheidsrechtelijke instanties of ordehandhavingsdiensten wanneer wij bijvoorbeeld:

• Gehoor moeten geven aan gerechtelijke bevelen of gerechtelijke procedures.
• Onze rechten willen uitoefenen / doen gelden.
• Ons dienen te verdedigen tegen rechtsvorderingen.
• Hiertoe uitgenodigd worden door ordehandhavingsdiensten.

Buiten de Europese Unie worden enkel Persoonsgegevens overgedragen als de ontvanger voldoet aan de wetgeving inzake Persoonsgegevensbescherming en indien de methode van overdracht voldoende bescherming biedt. Deze beschermingsmaatregelen omvatten onder andere contractuele bepalingen, het EUVS privacyschild of het oordeel van de Europese Commissie dat het betreffende land een adequaat niveau van Persoonsgegevensbescherming hanteert. Voor bepaalde delen van onze activiteiten kan het zijn dat Uw Persoonsgegevens in de ‘cloud’ worden opgeslagen. Wij brengen in herinnering dat landen buiten de Europese Economische Ruimte mogelijk niet dezelfde gegevensbescherming bieden als in België. Huidig privacy beleid blijft alleszins van toepassing op alle Persoonsgegevens die wij verwerken.

5 - Bescherming Persoonsgegevens

B.K.S.I. PACKING hecht veel belang aan de bescherming van Uw Persoonsgegevens. Daarom hebben wij maatregelen genomen om ervoor te zorgen dat Uw Persoonsgegevens niet misbruikt worden en dat onbevoegden er geen toegang toe hebben. Dit omvat ook maatregelen in geval van een vermoedelijk datalek of een inbreuk in verband met Persoonsgegevens. Indien U meent dat Uw Persoonsgegevens misbruikt werden, verloren zijn gegaan of dat onbevoegden er toegang toe hadden, gelieve B.K.S.I. PACKING hiervan onmiddellijk te verwittigen via e-mail naar commercial@bksi.be

Uw Persoonsgegevens worden bijgehouden op servers die door B.K.S.I. PACKING of door haar internetprovider gehost worden. Gegevensoverdracht via het internet is nooit volkomen veilig. Wij doen ons best om Uw Persoonsgegevens te beschermen maar kan de veiligheid van de Persoonsgegevens die U via de Website doorstuurt, niet garanderen. Deze overdracht is op eigen risico.

6 - Bewaren van Persoonsgegevens

B.K.S.I. PACKING houdt Uw Persoonsgegevens niet langer bij dan noodzakelijk. Voor de Betrokkenen met wie wij een contractuele relatie onderhouden, houden wij Uw Persoonsgegevens gedurende een periode van minstens 10 jaar bij. Hierna worden Uw Persoonsgegevens verwijderd behalve in die gevallen waar B.K.S.I. PACKING Persoonsgegevens moet bijhouden om aan haar wettelijke verplichtingen te voldoen, betwistingen op te lossen of onze overeenkomsten toe te passen. 7 - Uw rechten met betrekking tot Uw Persoonsgegevens

U hebt bepaalde rechten met betrekking tot Uw Persoonsgegevens. Zo heeft U, binnen de van toepassing zijnde wettelijke bepalingen, het recht te vragen dat we:

• U informeren omtrent en inzage geven in de Persoonsgegevens die we over U bijhouden.
• Uw Persoonsgegevens die fout of niet langer up-to-date zijn, corrigeren.
• Uw Persoonsgegevens verwijderen.
• De verwerking van Uw Persoonsgegevens beperken.
• Uw Persoonsgegevens overdragen aan een door U opgegeven derde dienstverlener.
• U één kopie bezorgen van de Persoonsgegevens die we over U verwerken.
• Uw rechtmatige bezwaren met betrekking tot ons gebruik van Uw Persoonsgegevens in acht nemen.

Daarenboven kan U zich ook verzetten tegen een verwerking van Uw Persoonsgegevens indien dit verzet gebaseerd is op wettelijk voorziene gronden. In dat opzicht informeren wij U dat U zich te allen tijde kan verzetten tegen een verwerking van Uw Persoonsgegevens:

1. Omwille van specifieke bijzondere redenen m.n. voor zover de verwerking gebaseerd is op derechtsgrond ‘taak van algemeen belang’ of ‘afweging van rechtmatige belangen’, met inbegrip vanprofilering die op die gronden plaatsvindt. De verwerking zal alsdan gestaakt worden, tenzijdwingende, gerechtvaardigde en zwaarder wegende gronden in onzen hoofde weerhouden moetenworden of voor zover de redenen van de verwerking verband houden met de instelling, uitoefening ofonderbouwing van een rechtsvordering.
2. In geval van directe marketing met inbegrip van profilering voor direct marketing doeleinden.
3. Met het oog op wetenschappelijk of historisch onderzoek of statische doeleinden tenzij de verwerkingnoodzakelijk is voor de uitvoering van een taak van algemeen belang.
4. Met het oog op een individuele geautomatiseerde besluitvorming zoals profilering waaraan voor Urechtsgevolgen zijn verbonden of dat U anderszins in aanmerkelijke mate treft.

B.K.S.I. PACKING zal alle verzoeken hieromtrent onderzoeken en beantwoorden. Mogelijk zal B.K.S.I. PACKING met het oog hierop vragen om haar bepaalde gegevens te verstrekken zodat U Uw identiteit kunt verifiëren alvorens zij Uw verzoek beantwoorden. Bepaalde Persoonsgegevens zijn onder bepaalde omstandigheden van dit soort verzoeken vrijgesteld. Als er een uitzonderingsregel geldt, brengt B.K.S.I. PACKING U hiervan op de hoogte in haar antwoord op Uw verzoek. Dit antwoord wordt U binnen 1 maand na het ingediende verzoek, bezorgt. Afhankelijk van de complexiteit van de verzoeken en het aantal van de verzoeken kan deze termijn indien nodig met 2 maanden worden verlengd.

Alle klachten in verband met de verwerking van Persoonsgegevens die B.K.S.I. PACKING ontvangt, worden zeer ernstig genomen. Indien U van oordeel bent dat wij Uw Persoonsgegevens verwerken op een manier die onrechtmatig, onbehoorlijk en onvoldoende transparant is, wil u ons hiervan in kennis te stellen. Indien U een klacht wenst neer te leggen over dit beleid of over de procedures die erin vervat zijn, neem dan met ons contact op door verzending van een e-mail naar commercial@bksi.be. Binnen de EU kan U ook een klacht neerleggen bij de toezichthouder inzake gegevensbescherming (in België de Gegevensbeschermingsautoriteit).

3 - Purpose of processing and legal basis

The Personal Data collected will be used in carrying out the activities, including:

• Customer management, i.e. everything to do with customer administration, service management, executionand invoicing of services, monitoring payments and solvency.
• Supplier management, i.e. everything to do with supplier administration. Management of enquiries,payment of Suppliers, prospecting of potential Suppliers and their evaluation.
• Merger/acquisition, i.e. anything to do with the transfer of Personal Data in the context of a merger with oran acquisition of all or part of the assets by another company.
• The fight against fraud and infringements, i.e. everything relating to activities aimed at preventing anddetecting such acts.
• Security, i.e. everything to do with the processing of Personal Data to ensure the safety of persons or goods,the safety and/or proper technical functioning of the IT network system, the Website, apps and products atleast to ensure the (physical) protection of the company and all this with a view to the continuity of services.

It does not matter whether the addressee is already a customer or not.

Such Personal Data shall only be processed insofar as such processing is lawful. In this regard, the processing of Your Personal Data is essentially necessary for the proper performance of the contracts entered into with You or to take measures at Your request prior to the conclusion of a contract. The processing may also be necessary if a legal obligation incumbent on B.K.S.I. PACKING must be complied with whereby reference may be made, inter alia, to the legal obligations concerning tax law and social law. Furthermore, B.K.S.I. PACKING may also be subject to obligations in the context of judicial or extrajudicial disputes, by law enforcement agencies, public authorities, etc. Occasionally, the processing of your Personal Data will be carried out in order to protect Your vital interests or those of another natural person. In addition, processing may sometimes be carried out for legitimate interests on the part of B.K.S.I. PACKING. If you make use of the Website, B.K.S.I. However, Your Personal Data may be shared with the following categories of recipients, among others, if the legal conditions are met:

We may share Your Personal Data with Processors. This includes, for example:

These Processors are appointed by B.K.S.I. PACKING and are therefore also authorised to process Your Personal Data to the extent necessary for our services. In doing so, however, the Processors must take into account the instructions and privacy policy of B.K.S.I. PACKING.

B.K.S.I. PACKING may need to share your Personal Data with judicial or arbitration authorities or law enforcement agencies when, for example:

• Have to comply with court orders or legal proceedings.
• Want to exercise/enforce our rights.
• Need to defend ourselves against legal claims.
• Are invited to do so by law enforcement agencies.

Outside the European Union, Personal Data will only be transferred if the recipient complies with Personal Data Protection legislation and if the method of transfer provides adequate protection. These protections include, inter alia, contractual provisions, the EU-US Privacy Shield or the European Commission’s assessment that the country in question has an adequate level of Personal Data Protection. For certain parts of our business, Your Personal Data may be stored in the ‘cloud’. We recall that countries outside the European Economic Area may not offer the same data protection as Belgium. The present privacy policy remains in any case applicable to all Personal Data we process.

5 - Personal Data protection

B.K.S.I. PACKING attaches great importance to the protection of Your Personal Data. We have therefore taken measures to ensure that Your Personal Data is not misused and unauthorised persons cannot access it. This includes measures in case of a suspected data breach or Personal Data breach. If You believe that Your Personal Data has been misused, lost or accessed by unauthorised persons, please notify B.K.S.I. PACKING immediately by email to https://www.bksi.be/.

Your Personal Data is held on servers hosted by B.K.S.I. PACKING or by its internet service provider. Data transmission over the internet is never completely secure. We do our best to protect Your Personal Data but cannot guarantee the security of the Personal Data You transmit via the Website. Any such transmission is at Your own risk.

6 - Retention of Personal Data

B.K.S.I. PACKING does not keep Your Personal Data for longer than necessary. For those Data Subjects with whom we maintain a contractual relationship, we will keep Your Personal Data for a period of at least 10 years. Thereafter, Your Personal Data will be deleted except in those cases where B.K.S.I. PACKING needs to maintain Personal Data in order to comply with its legal obligations, resolve disputes or enforce our agreements. 7 - Your rights in relation to Your Personal Data

You have certain rights in relation to Your Personal Data. For example, within applicable legal provisions, You have the right to request that we:

• Provide You with information about and access to the Personal Data we hold about You.
• Correct your Personal Data which is incorrect or no longer up-to-date.
• Deleting Your Personal Data.
• Limit the processing of Your Personal Data.
• Transfer Your Personal Data to a third-party service provider specified by You.
• Provide You with one copy of the Personal Data we process about You.
• Consider Your legitimate objections regarding our use of Your Personal Data.

In addition You may also oppose any processing of Your Personal Data if such opposition is based on legally foreseen grounds. In that regard, we inform You that You may oppose any processing of Your Personal Data at any time:

1. Because of specific special reasons, in particular insofar as the processing is based on the legal ground “public-interest task” or “balancing of legitimate interests”, including profiling carried out on these grounds. The processing will then cease, unless compelling, justified and overriding grounds on our behalf must be withheld or insofar as the reasons for the processing relate to the establishment, exercise or substantiation of legal claims.
2. In case of direct marketing including profiling for direct marketing purposes.
3. For the purpose of scientific or historical research or statistical purposes unless the processing is necessary for the performance of a task carried out in the public interest.
4. For the purpose of individual automated decision-making such as profiling which has legal consequences for You or which otherwise significantly affects You.

B.K.S.I. PACKING will investigate and respond to all requests in this regard. It is possible that, for this purpose, B.K.S.I. PACKING will ask You to provide her with certain data so that You can verify Your identity before answering Your request. Certain Personal Data are exempt from such request under certain circumstances. If an exemption applies, B.K.S.I. PACKING will inform You of this in its response to Your request. This response will be provided to You within 1 month of the request being made. Depending on the complexity of the requests and the numbers of requests, this deadline may be extended by 2 months if necessary.

All complaints relating to the processing of Personal Data received by B.K.S.I. PACKING are taken very seriously. If You believe that we are processing Your Personal Data in a manner that is unlawful, improper and insufficiently transparent, please notify us.
